Be aware that you and any accompanying J-2 spouse and dependent also may be subject to the requirements of the Affordable Care Act.

How Do I File A Complaint

The Washington state Office of the Insurance Commissioner protects insurance consumers and oversees the insurance industry.

If you have a problem with your insurance company, the OIC can require it to explain its actions and make sure it followed Washington state laws and your policy.

Complaints can be filed over the phone, or via the OIC website.

Can Employees Opt Out Of The Program

Yes, an employee may opt out of the Program and its taxes and benefits if:

  • The employee is 18 years old or older on the date he or she applies for the exemption, and
  • The employee attests that he or she has other long-term care insurance.

To opt out, the employee must provide identification to verify his or her age and must apply for exemption with ESD between October 1, 2021, and December 31, 2022. If approved, an employees exemption will be effective for the quarter immediately following approval. Once an employee opts out, the employee cannot opt back into the Program. The opt-out is permanent.

All wages and other compensation, including stock-based compensation, bonuses, paid time off, and severance pay, are subject to the tax. Buying Coverage Directly From An Insurer

You may wish to buy health insurance directly from an insurance company if your doctor or provider is not available through any of the QHPs in the Exchange but is available through a plan sold directly by an insurer. The biggest disadvantage of buying health insurance directly from an insurance company is that you cannot receive Premium Tax Credits or Cost-Sharing Reductions unless you purchase a QHP through the Exchange. This means that if your income is below 400% of the Federal Poverty Level, a QHP will likely be more affordable than buying insurance directly.

Also note that if you bought individual insurance directly from an insurance company before the ACA was passed on March 23, 2010 and its benefits and costs have not changed much, you may be able to keep it if it is considered a grandfathered plan.
